Terms of Use

Welcome to swapkidsclothes.com.au where the name says it all, and our member's happiness is essential. We are an Australian-based website where membership is currently limited to Australian residents.

Becoming a member is easy but before you do (and to keep our legal guys happy) please read and agree to our Terms of Use below.  Our Terms of Use set out the terms on conditions of membership and our important rules.

The website is owned and operated by Swap Kids Stuff Pty Ltd ACN: 137 693 513.

Our Terms of Use, like all things, will change from time to time and when they do we’ll endeavour to give you at least 30 days notice, but in some circumstances it may be less, therefore we suggest you periodically review these Terms. If you continue to use the site after the effective date of an amendment then you accept that amendment.

Terms of Use

 The following terms and conditions apply to members of swapkidsclothes.com.au (the “website”):

1. Memberships are not transferable. This means your account and User ID may not be used, transferred or sold to another party.
2. Swap Kids Stuff Pty Ltd reserves the right to terminate membership for any reason. In particular if it believes the service is misused. 
3. You accept responsibility for everything that is done on or through your membership or through your email address(es)
4. SwapPoints™ are not redeemable for cash and will not expire as long as your membership remains current.
5. How many SwapPoints™ your items attract is based on a sliding scale linked to differences in size and item type (linked to their retail value).
6. Services and Fees. Members get 12 months unlimited access to the website; however we charge a small handling on every order placed. From time to time we may temporarily alter our fees (for example, to attract new members) and such changes are effective when we post the promotional event on the site. We may change some or all of our services at any time. In the event we introduce a new service, the fees for that service are effective at the launch of the service. All fees are in Australian Dollars (AUD) and include GST.
7. You are not required to deal with other Members directly.
8. Warranty. We cannot and will not provide any warranty in relation to any goods or services traded on the website.
9. Exchange & Returns. If Members are not happy with item(s) received they can return them at their expense (postage) within 7 days for the equivalent SwapPoint™ value.
10. Guarantee. If Members do not believe an item(s) they received meets the stated Clothing Condition Assurance Policy, we will give you your SwapPoint™ back once we have been provided with an image of the item(s) in question.
11. We will not be held responsible for any illegal or fraudulent activity conducted through the website including but not limited to the trade of stolen goods.
12. Trademark. The content, logos etc contained within swapkidsclothes.com.au are protected under copyright law and international treaties. Users must not copy, distribute, exploit or modify content (other than their own) from swapkidsclothes.com.au without our prior written consent.
13. All images including logos remain the property of Swap Kids Stuff Pty Ltd and cannot be reproduced in anyway without the consent of Swap Kids Stuff Pty Ltd prior to production.
14. Security. Your details are protected by a SSL (secure socket layer) on this site. The website uses ANZ eGate which allows online payment by Mastercard or Visa. Swapkids communicates with ANZ eGate using Secure Socket Layering (SSL) with 256 bit encryption, ensuring the highest possible level of security to you. During the payment process we never view, nor store your financial details. 
15. Privacy. We will only collect personal information for purposes such as; processing your order, corresponding with you, providing you with a newsletter (upon subscription only).  We may contact you from time to time for member satisfaction surveys or in connection with certain transactions. We DO NOT share your personal information with any other organisation or persons.
16. Swap Kids Stuff Pty Ltd take great care to ensure all images and descriptions are created as accurately as possible however Swap Kids Stuff Pty Ltd takes no responsibility for slight variations.
17. Clothing Condition Assurance Policy. To protect our members' interests, we maintain the right to not accept items that are or have:  

• Dirty
• Pilling
• Tears
• Stained
• Faded
• Missing buttons
• Stretched or out of shape
• Broken zips
• Velcro, studs, laces not in good working order
• Illegible brand & size tag
• Incorrect size (i.e. we only currently accept size 0000 to size 5 inclusive)
• Offensive symbols, slogans or pictures
• Sleepwear (except babies), underwear, socks, shoes, hats, bibs

If your item(s) do not meet our clothing condition assurance standard as stated above we will donate these items directly to a charity on your behalf.
